Terms of Service

Last updated: October 10, 2026 · avesom Web Services

1. Acceptance and Eligibility

These Terms of Service (the "Terms") govern your use of the website at web.avesom.com (the "Site") and the services we offer through it (the "Services"). The Site and the Services are provided by Avesom Web Services, doing business as avesom web and Zen Webmaster ("we", "us"), Wilmington, DE.

1.1 Acceptance. By using the Site, requesting a free audit, or buying a Service, you agree to these Terms. If you accept them on behalf of a company, you confirm that you have the authority to bind it, and "you" means that company. If you do not agree, do not use the Site or the Services.

1.2 Business customers only. The Services are strictly for business and commercial use. When you purchase, you confirm that you act for a business or organization and not as a consumer for personal, family, or household purposes. You must be at least 18 years old.

1.3 Other agreements. A separate written agreement or order form that we sign with you (for example, for a new-site lease-to-own plan under Section 9) prevails over these Terms where the two conflict.

1.4 Privacy. Our Privacy Policy explains how we handle personal information.

2. The Services

We offer:

  • Free site audit: a short written review of a public website, described in Section 5.
  • Care plans: monthly maintenance and support for WordPress, Shopify, Drupal, and PrestaShop sites, in the tiers shown on the pricing page.
  • Development hours: prepaid packages of hours for custom code changes, refactors, and technical improvements.
  • One-time services and content updates: emergency cleanup of a hacked site, platform migrations, Core Web Vitals speed overhaul, and content edits.
  • New sites: websites built, maintained, and transferred to you under an Ownership Transfer agreement.

The descriptions on the Site, including what each plan includes, are part of these Terms. We may improve or update the Services. During a billing period you have already paid for, we will not materially reduce what your plan includes.

3. Orders and Prices

3.1 Ordering. You order a Service by completing checkout on the Site or by signing an electronic order form. We accept an order when we confirm it by email or begin the work.

3.2 Prices. Prices are in US dollars and are shown on the Site when you order. They exclude sales, use, and similar taxes, which we add where applicable law requires. They also exclude third-party costs such as hosting, domain names, platform subscriptions (for example a Shopify plan), paid plugin or theme licenses, and email services ("Third-Party Costs").

3.3 Price changes. We may change prices for new orders at any time. The price of an active care plan remains fixed for 24 months from its start for the same scope. After that, we will provide at least 30 days' advance notice by email before any change takes effect.

3.4 Billing details. You agree to provide accurate, current billing details and keep them up to date in the customer portal.

4. Billing, Cancellation and Refunds

4.1 Subscriptions. Care plans and monthly content update packages are recurring subscriptions. They renew automatically each month at the rate stated at checkout until you cancel. We charge each period in advance.

4.2 Payment. You pay with the methods offered at checkout, currently major credit/debit cards and ACH debit, processed securely through Stripe. You authorize us and Stripe to charge your payment method for each renewal and for other ordered services. We do not store full card numbers.

4.3 Failed payments. If a payment fails, we notify you and retry. If we cannot collect within 10 calendar days after notice, we may suspend the Services until paid, and may cancel the subscription.

4.4 Cancellation. You may cancel a care plan at any time after the first month. Use the link to the Stripe customer portal in your receipt email or write to [email protected]. Cancellation takes effect at the end of the billing period you have already paid for, and no further charges will occur.

4.5 Refunds.

  • Subscription fees are generally not refunded for a billing period that has already commenced. However, under our 30-day money-back guarantee, if you notify us within 30 days of your initial plan onboarding payment that you are dissatisfied with our stewardship, we will refund that initial payment in full.
  • Fees for completed development hours or emergency remediation labor already executed are non-refundable. If we cannot deliver an agreed one-time Service, we refund the pro-rata portion not delivered.
  • We refund duplicate or erroneous charges in full.

4.6 Disputed charges. If you believe a charge is incorrect, please contact us at [email protected] before initiating a bank chargeback, and we will resolve it promptly. We reserve the right to pause active maintenance while a formal payment dispute is open.

5. Free Site Audit

5.1 What it is. The free audit is an executive review of publicly available information about your website, covering performance, visible update posture, forms, security headers, and Core Web Vitals signals. We deliver it by email, normally within one Business Day.

5.2 Limits. The audit is provided for informational purposes only. It is not an invasive penetration test, source-code decompilation, or legal/accessibility certification. For the free audit, we do not require administrative passwords, and we do not run intrusive exploits.

5.3 Your confirmation. You confirm that you own or manage the website domain you submit, or that its authorized owner has granted permission. We may decline requests that appear abusive or target websites you do not manage.

5.4 No obligation. Requesting an audit creates zero obligation to purchase paid services.

6. Access and Your Responsibilities

6.1 Access. To deliver paid Services, we require access to your site CMS, hosting panel, DNS, and relevant development accounts. Where supported, access should be provided via individual named collaborator accounts rather than shared master root passwords.

6.2 Authority. You confirm that you own the website or hold legal authority to grant technical access, and that doing so does not breach your agreements with third-party hosting or software providers.

6.3 Your accounts. Your domains, hosting subscriptions, platform licenses, and merchant accounts remain in your legal name and under your direct control.

6.4 Your content and legal compliance. You are solely responsible for your website's published content, product pricing, intellectual property, and compliance with laws (including ADA/WCAG accessibility, privacy regulations, and ecommerce disclosures). We do not provide legal counsel.

6.5 Changes by others. Please notify us before you or external third parties modify code, plugins, or server configurations. Errors or regressions caused by external modifications are not covered under base care plans and may be billed as additional development hours.

6.6 Backups and credentials. We maintain automated snapshots as specified in your plan tier, but you remain responsible for maintaining your own independent offline copies of business data. Keep credentials secure and alert us immediately if credentials may have leaked.

7. Support and Service Levels

7.1 Support hours. Standard support is available Monday through Friday, 9:00 AM to 6:00 PM Eastern Time, excluding US federal holidays ("Business Days"). Support requests should be submitted to [email protected].

7.2 Response targets. Response targets for each plan tier are stated on the Site (e.g. 1 Business Day, or 4 business hours on higher tiers). This metric represents an initial response and diagnostic engagement target.

7.3 Included edits. Routine content edits included in plans are counted per calendar month and do not roll over.

7.4 What is not covered. Standard care plans do not cover defects caused by third-party hosting outages, unmaintained abandonware plugins, ground-up feature development, or force majeure events. Such work can be scheduled under dedicated dev hours packages.

7.5 Security incidents. If we detect a security vulnerability or unauthorized intrusion, we notify you promptly and take containment measures. Remediation of pre-existing vulnerabilities or compromised credentials outside our management scope may be billed as an emergency cleanup package.

8. Development Hours and One-Time Services

8.1 Development hours. Packages of 5, 10, or 20 hours may be used for custom changes and engineering tasks. Time is logged in 15-minute increments with transparent timesheets. For substantial modifications, scope is agreed upon in writing via email before commencement.

8.2 Expiry & Rollover. Dev hours packages include a generous 60-day rollover window; unused hours beyond 12 months from purchase expire and are non-refundable.

8.3 Hourly rate. Work requested beyond an active pack is billed at the standard hourly rate posted at the time of order.

8.4 One-time services. Services such as malware cleanup, site migration, and speed optimization are executed as scoped upon purchase. We require timely access; delays on the client side adjust delivery estimates accordingly. While we apply best engineering practices, we cannot warrant that third-party code will never be re-targeted by automated web exploits.

8.5 Acceptance. If completed work does not match agreed specifications, notify us within 7 calendar days for immediate rectification.

9. New Sites on Ownership-Transfer Plans

9.1 Separate agreement. Projects where we build a new custom website, steward it for 24 months, and transfer full ownership upon lease buyout are governed by a signed Ownership Transfer Agreement. Site figures represent summaries.

9.2 Order of precedence. If the Ownership Transfer Agreement conflicts with these Terms, the specific Ownership Transfer Agreement governs for that project.

9.3 Commercial qualification. Lease-to-own arrangements are reserved for commercial entities, subject to review.

10. Intellectual Property

10.1 Our Site. The Site, including copy, visual brand identity, code, and the marks avesom, avesom web, and Zen Webmaster, are owned by us or our licensors. You receive a limited, revocable license to access the Site for business purposes. Scraping, unauthorized copying, or resale is prohibited.

10.2 Your Content. You retain 100% full legal title to your content, databases, logos, trade secrets, and domain names ("Your Content"). You grant us a limited license to host and edit Your Content solely to deliver the agreed Services.

10.3 Deliverables. Custom software, themes, styling, and copy created specifically for your website under development hours or one-time orders become your property upon payment in full. We retain ownership of our pre-existing utilities, deployment scripts, and general know-how, for which you receive a perpetual, non-exclusive license.

10.4 Third-party software. Open-source CMS platforms (WordPress, Drupal, PrestaShop), SaaS systems (Shopify), and third-party plugins remain governed by their respective licenses (e.g. GPL, MIT, proprietary terms).

10.5 Feedback. Unsolicited suggestions or ideas you submit regarding our Services may be implemented without royalty or duty.

10.6 Infringement inquiries. If you believe material hosted on our Site infringes your intellectual property, write to [email protected] with detailed notice.
